These Terms and Conditions apply to Priceless Gift Certificates (“Gift Certificates”) issued by MASTERCARD ASIA/PACIFIC (AUSTRALIA) PTY LTD (ABN 95 108 603 345) (“Mastercard”) of 72 Christie St, St Leonards NSW 2065.
By purchasing or using a Gift Certificate, you are agreeing to and accept the below Terms and Conditions.
Gift Certificates can only be used for Priceless Cities experiences on priceless.com.
Gift Certificates will be in denominations of $100AUD or such other denominations as Mastercard may determine at its sole discretion from time to time.
Gift Certificates cannot be used to purchase other Gift Certificates.
Where a Gift Certificate has been physically provided, the recipient will receive a physical voucher with a code that can be applied at the checkout on priceless.com.
To redeem a Gift Certificate at checkout on priceless.com, the "promo code/gift certificate" option should be selected, and the code associated with the Gift Certificate should be entered on the website.
8Gift Certificates are not reloadable and cannot be used to obtain or redeem cash. Except as may be provided under applicable law, the amount on Gift Certificates will not be refunded to a purchaser under any circumstances. No refund will be provided in cash, at any point of time.
Gift Certificates are in a single currency, being AUD, and should not be used in connection with foreign currencies.
Gift Certificates do not have an expiry date and are valid from the date of issue.
Lost or stolen Gift Certificates will not be replaced, so always keep the Gift Certificate secure. Any balance on a lost or stolen Gift Certificate will be forfeited.
Gift Certificates can be used multiple times until the available balance associated with the Gift Certificate has been redeemed. The available balance on a Gift Certificate cannot be exceeded.
Where a purchase exceeds the available balance on a Gift Certificate, the Gift Certificate recipient must add a valid Mastercard card to complete the Priceless Cities purchase.
When using your Gift Certificate at some merchants or to make bookings on priceless.com, you may be required to authorize an amount above the purchase price for additional charges or incidentals for tips or held funds, e.g., restaurants, hotels, car rental, travel etc.
Unused Gift Certificate balances can be checked online in the priceless.com checkout cart upon entering the code associated with the Gift Certificate.
Unused Gift Certificate balances may not be transferred to another person. No interest will be payable by on any Gift Certificates or Gift Certificate balance.
Mastercard makes no representation or warranty that www.priceless.com will always be accessible without interruption.
MASTERCARD DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTIFICATE IS NON-FUNCTIONAL, YOUR SOLE REMEDY WILL BE THE REPLACEMENT OF SUCH GIFT CERTIFICATE. IF APPLICABLE LAW DOES NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Mastercard does not charge any activation fees, account keeping fees, and or balance enquiry fees associated with Gift Certificates.
Mastercard reserves the right to change these Gift Certificate Terms and Conditions from time to time in its sole discretion and without prior notice to you. All Terms and Conditions are applicable to the extent permitted by law.
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales. You, agree to submit to the exclusive jurisdiction of the courts at New South Wales.
You agree to indemnify Mastercard for all claims brought by a third party against Mastercard or its affiliates arising out of or in connection with a breach of any of these Terms and Conditions by you.
Mastercard may collect information including but not limited to name, telephone number, email address and postal address from you ("PI") to facilitate the redemption of Gift Certificates on priceless.com and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and, as required, to Australian regulatory authorities. Mastercard will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.priceless.com/privacy.
