TERMS AND CONDITIONS

 

  1. Information on how to enter this promotion and the prizes form part of these Terms and Conditions of entry (“Terms and Conditions”). Participation in this promotion is deemed acceptance of these Terms and Conditions as set out below. Headings in this document are included for ease of reference and do not affect interpretation in any way.

  2. The promoter is Mastercard Asia/Pacific (Australia) Pty Ltd (ABN 95 108 603 345) of 72 Christie Street, St Leonards NSW 2065, telephone 1800 120 113 (“Promoter”).

  3. The Promotion will commence at 9:00AM AEDT on 1 December 2024 and will close at 11:59PM on 31 December 2024 (the “Promotional Period”). Entries received after this closing time will be ineligible for entry.


    CONDITIONS OF ENTRY

  4. Any person who enters the Promotion is an “Entrant”. Valid entry is open to individuals aged 16 years or over (“Eligible Entrants”).

  5. Employees (and their immediate families) of the Promoter, Australia Post and any other agencies associated with this promotion are ineligible to enter and shall not be deemed Eligible Entrants. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

  11. All references to amounts in dollars under these Terms and Conditions are references to the Australian Dollar (AUD).

  12. To be eligible to enter, Entrants must (1) carry out a Qualifying Transaction (as provided below) within the Promotion Period and (2) undertake the Registration Requirements within the Promotional Period (as outlined below).

  13. An Entrant can carry out a Qualifying Transaction through the following options:

      ·   (Entry for new cardholders) Purchase an ‘Australia Post ‘Gift Card by Mastercard’’ (physical) of AU$100 or more in the same transaction https://auspost.com.au/money-insurance/buy-gift-cards/auspost-gift-card) from Australia Post. Purchases can be made from Australia Post in-store or online.

      For the avoidance of doubt, if an Entrant purchases an Australia Post “Gift Card by Mastercard” and loads AU$300 in the same transaction, the Entrant is eligible for three (3) entries into the Prize Draw from the same Qualifying Transaction. 

      ·   (Entry for new cardholders) Purchase an Australia Post ‘Everyday Mastercard’ (https://auspost.com.au/money-insurance/prepaid-cards/everyday-mastercard) and load AU$100 or more (or of equivalent foreign currency) in the same transaction.

      For the avoidance of doubt, if an Entrant purchases an Australia Post “Everyday Mastercard” and loads AU$300 (or AU$300 in equivalent foreign currency) in the same transaction, the Entrant is eligible for three (3) entries into the Prize Draw from the same Qualifying Transaction.  

      ·   (Entry for new cardholders) Purchase an Australia Post “Travel Platinum Mastercard” (https://auspost.com.au/money-insurance/travel-money-and-services/travel-platinum-mastercard) load AU$100 or more (or of equivalent foreign currency) in the same transaction

      For the avoidance of doubt, if an Entrant purchases an Australia Post “Travel Platinum Mastercard” and loads AU$300 (or AU$300 in equivalent foreign currency) in the same transaction, the Entrant is eligible for three (3) entries into the Prize Draw from the same Qualifying Transaction. 

      ·   (Entry for existing cardholders) Reload an existing Australia Post ‘Everyday Mastercard’ card with AU$500 or more (or equivalent foreign currency) in the same transaction. Purchases can be made from Australia Post in-store or online.

      For the avoidance of doubt, if an Entrant reloads an existing Australia Post “Everyday Mastercard” with $AU2000 (or in equivalent foreign currency) in the same transaction, the Entrant is eligible for four (4) entries into the Prize Draw from the same Qualifying Transaction.

      ·   (Entry for existing cardholders) Reload an existing Australia Post ‘Travel Platinum Mastercard’ card with AU$500 or more (or equivalent foreign currency) in the same transaction. Purchases can be made from Australia Post in-store or online.

      For the avoidance of doubt, if an Entrant reloads an existing Australia Post “Travel Platinum Mastercard” with $AU2000 (or in equivalent foreign currency) in the same transaction, the Entrant is eligible for four (4) entries into the Prize Draw from the same Qualifying Transaction.

      (each a “Qualifying Transaction”). If a receipt is not automatically provided to an entrant at the time of making a Qualifying Transaction, it is the entrant’s responsibility to request one.


  14. For each Qualifying Transaction, an Eligible Entrant must complete the Registration Requirements set out below, to gain entry into the Prize Draw.
  15. For the avoidance of doubt, if an Eligible Entrant carries out two (2) Qualifying Transactions, the Eligible Entrant must fulfil the Registration Requirements two (2) times in order to gain all eligible entries into the Prize Draw for all Qualifying Transactions.


  16. For a valid entry into the Prize Draw, Eligible Entrants who have carried out a Qualifying Transaction must visit https://www.priceless.com/auspost2024 and register by inputting the requested details, including their full name, valid email, contact number and the corresponding proof of purchase details when prompted, and submit the fully completed online entry form within the Promotional Period (“Registration Requirements”).

  17. Proof of purchase details can be any of the following:
  18. i.   Receipt Number (for card(s) purchased instore)

    ii.   Tax Invoice Number (for physical gift card(s) purchased online)

    iii.   Reference Number (If Everyday Mastercard or Travel Platinum Mastercard is reloaded online or via the app)

    Eligible Entrants will need to provide the relevant details (as applicable to the transaction) in order to fulfil the Registration Requirements for entry into this Promotion.


  19. Eligible Entrants will need to complete the Registration Requirements steps for each Qualifying Transaction. If an Eligible Entrant has only completed the Registration Requirements once and has completed two Qualifying Transactions, the Eligible Entrant will only gain entries into the Prize Draw for the Qualifying Transaction with Registration Requirements fulfilled.

  20. Entrants are eligible for multiple entries subject to the following:
  21. i.   Each Qualifying Transaction must be registered separately and in accordance with Registration Requirements.

  22. Qualifying Transactions made or Registration Requirements completed outside the Promotional Period will be ineligible for entry into the Promotion. Where an Entrant returns or has a gift card product refunded that constitutes a Qualifying Transaction for the purposes of these Terms and Conditions, the Entrant will have their entry invalidated, subject to the Non-Excludable Guarantees.

  23. Any cost associated with accessing the Promotion website is the Entrant’s responsibility and is dependent on the internet provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.

  24. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase.

  25. The Promoter, reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  26. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.

  27. Incomplete, indecipherable or illegal Entries from Eligible Entrants will be deemed invalid.

  28. PRIZE AND PRIZE REDEMPTION

  29. This is a game of chance and winning Entries of Eligible Entrants will be selected at random (“Prize Draw”). Eight (8) Eligible Entrants will be drawn from the Prize Draw to win the Prize(s) as set out below (“Winner(s)”). Each Eligible Entrant is only eligible for winning one (1) Prize during the Promotional Period irrespective of number of entries (excluding Eligible Entrants residing in South Australia).

  30. The Prize Draw will be conducted at Anisimoff Legal (“Drawer”), 3 Amy Close, Wyong, NSW, 2259 at 11:30AM AEDT on 7 January 2025, in the presence of an independent scrutineer. The Drawer may draw additional reserve entries and record them in order, in case an invalid entry or ineligible entrant is drawn. Attempts will be made to notify the winners by phone call and via email within two (2) days of the draw. A minimum of three (3) attempts will be made to contact the Winners. Winners will be deemed provisional winners, until verified.

  31. If the Promoter, having used reasonable efforts, is unable to contact the winner, then the prize is forfeited, and an alternative winner will be selected at random via the unclaimed prize draw. If a winner is deemed invalid or ineligible, the Promoter will revert to a reserve entry drawn.

  32. The Promoters' decision is final, and no correspondence will be entered into.

  33. Winners’ details (first initial and surname) will be published online at https://mastercard.com.au/auspost2024 on 8 January 2025.

  35. Prizes include:
  36. i.   The first six (6) valid entries drawn will each win a double pass to the 2025 Australian Open day session in Rod Laver Arena to watch the Men’s Semifinal on 24 January 2025 (valued at $1,978.00). Winner(s) may choose to take one (1) guest with them.

    ii.   The next valid entry drawn will win a double pass to the 2025 Australian Open evening session in Rod Laver Arena to watch the Men’s and/or Women's Quarterfinals on 21 January 2025 (valued at $1,648). The Winner may choose to take one (1) guest with them.

    iii.   The next valid entry drawn will win a double pass to the 2025 Australian Open for entry to the day session in Rod Laver Arena to watch the Men’s and/or Women’s Quarterfinals on 22 January 2025 (valued at $1,208). The Winner may choose to take one (1) guest with them.

  37. Prizes consist of 2025 Australian Open Passes only. The Winner is responsible for paying all additional costs associated with the Prize that are not specifically included, including (where applicable) transport, meal costs, spending money.

  38. Prize must be taken to coincide with the relevant 2025 Australian Open event awarded by the Promoter. The respective Prize must be redeemed by the Winner(s) on the date listed on the respective 2025 Australian Open Pass.

  39. If any nominated guest is under the age of 18 years of age (“Underage Person”), a nominated parent/guardian must accompany the Underage Person for the full duration of the Prize. The Prize is subject to the standard terms and conditions of individual prize and service providers.

  40. All Australian Open tickets are issued subject to the Australian Open Ticket Conditions of Sale and Entry 2025 (which can be found online at https://ausopen.com/conditions-of-sale-entry) including any applicable age restriction.  Winners consent to Tennis Australia Limited using their personal information and photographing/recording them while they are participating in the any activity or event run or organised by Tennis Australia which constitutes part of the prize. Winners agree that any such photographs, electronic images, sound recording or video footage may be used by Tennis Australia in resources and reports, or promotional, advertising or marketing materials, without any further notice or payment to the winner. Further, the Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

  41. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

  42. Subject to the unclaimed prize draw clause, if for any reason a winner does not take/ redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

  43. The Promoter will not be held responsible for the Winners and/or guests not taking advantage of the Prize due to health or any other reason.

  44. Sale, transfer or exchange of any part of a Prize is strictly prohibited. Any attempt to sell, transfer or exchange any part of the Prize will result in the Prize being withdrawn by the Promoter and the Prize will be declared null and void.

  45. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  46. If the Promotion is not capable of running as planned for any reason beyond the reasonable control of Mastercard, including but not limited to tampering, unauthorised intervention, acts or omissions of third parties, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Mastercard reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority to cancel, terminate, modify or suspend the Promotion and prior notice may be given where it is reasonably practicable to do so.

  47. Total prize pool value is $14,724. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  48. A draw for any unclaimed prizes will take place on 14 January 2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by phone and in writing by email within two (2) days of the draw and their details (first initial and surname) will be published online at https://mastercard.com.au/auspost2024 on 15 January 2025.

  49. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  50. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  51. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the relevant 2025 Australian Open  event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.

  52. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.mastercard.com.au/en-au/vision/corp-responsibility/commitment-to-privacy/privacy.html. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI outside of Australia (see the Promoter’s Privacy Policy for more details), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles.  By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
